Well thats mostly untrue the footage is never meant to be seen. When filming, directors are looking for the best take or combination of takes. They dont always know which theyll use, plus the editor will look over footage to pick what they need. The leftover footage is often added to Blu-ray and DVDs as Bonus Features. Unless an actor has a special clause in their contract, everything they film is owned by the production. Usually only the biggest stars get those kinds of concessions. The Screen Actors Guild (SAG) suggests actors negotiate anudity rider that can be added to contracts specifying limits on nudity and simulated sex scenes. Even after signing such riders the actor can still withdraw consent at any time.
