Not all marriages are considered to be purely a contract by the law. Ex- hindu marriage is both a sacrament and a contract whereas muslim marriage is essentially a contract. Do note that though a marriage may be a contract, the process of marriage itself is not one. There aren't any negotiations involved (even dower etc are formalities not terms) and one is not at the luxury to add clauses as one pleases. This is purely a concept brought in knowledge from western influences (tb shows and movies). Prenuptial agreements do take place in various countries around the world and violation of those terms can lead to divorce. This isn't the scene in India. Dissolution of marriage has to take place in accordance with the prevalent law and cannot be done on grounds which are not inscribed in the statutes. For a divorce to take place, there hace to be certain conditions to be met and proof of such to be given. We are not as forgiving about the concept of divorce as the first world is. A divorced person is looked at as if they've contracted a veneral disease or is suffering from unspeakable trauma. Where in many countries divorce is granted simply because the parties are unable and unwilling to live together and the courts simply allow them to go separate ways. In India such wouldn't ever be possible where the courts not only do not recognize no-fault divorces in a uniform fashion, but are still struggling to recognize the concept of an 'irretrievable breakdown of marriage' which does not fit into the pigeon holes of the grounds of marriage prescribed by the law.
